Senate Bill (SB) 277 - Immunizations

Governor Brown signed Senate Bill (SB) 277 on June 30, 2015. Effective one year from now in July 2016, SB 277 will:
  • No long permit immunization exemptions based on personal beliefs for children in child care and public and private schools;
  • Permit personal belief exemptions submitted before January 1, 2016 to remain valid until a student reaches kindergarten or 7th grade;
  • Remove immunization requirements for:
  • Students in home-based private schools
  • Students enrolled in an independent study program who do not receive classroom-based instruction
  • Access to special education and related services specified in an individualized education program (IEP).
  • Allow medical and personal beliefs exemptions from any new immunization requirement initiated by CDPH for attendance at school or child care.
State law does not exempt from vaccination requirements student who qualify for an individualized education program (IEP). However, Health and Safety Code 120335, as amended by SB 277, specifies that its provisions do not prohibit a student who qualifies for an IEP from "accessing any special education and related service" required by his/her IEP. The district should consult with legal counsel if it has questions about how to ensure compliance with vaccination requirements consistent with a student's IEP. The district may want to consider holding an IEP meeting to resolve any potential conflicts with the IEP.

SB 277, authored by State Senator Richard Pan, went into effect on January 1, 2016. The bill amends sections 120325, 120335, 120370, and 120375 of Health and Safety Code. The bill also adds Section 120338 and repeals Section 120365 of Health and Safety Code.

SB 277 eliminates the exemption from existing specified immunization requirements on the basis of personal beliefs but would allow exemption from future immunization requirements deemed appropriate by the State Department of Public Health (DPH) for either medical reasons or personal beliefs. The bill also exempts children in specified programs.

Education Code Section 120335 has been amended to add subsection (h), which says, "This section does not prohibit a pupil who qualifies for an individualized education program, pursuant to federal law and Section 56026 of the Education Code, from accessing any special education and related services required by his or her individualized education program."
